Nunn applies to Supreme Court

CONVICTED killer Kevin Nunn has taken the first step towards putting his case before the highest court in the land.

 

Kevin Nunn, of  Woolpit, was convicted of murdering his ex-girlfriend Dawn Walker, 39,  in November 2006 and is serving a minimum 22-year sentence.

His case reached London’s High Court earlier this year as Nunn’s QC, Hugh Southey, challenged a refusal by the Chief Constable of Suffolk and the Crown Prosecution Service to allow his legal team to re-examine forensic evidence in the case.

Mr Southey claimed semen samples discovered on Ms Walker’s body could not be attributed to Nunn as he had undergone a vasectomy.

Nunn’s challenge to the police and CPS stance was dismissed by the High Court last month, but his lawyers are now bidding for the right to take his case to the Supreme Court.

Top judge, Sir John Thomas, said last week that Nunn’s case raises issues of ‘general public importance’ relating to the Crown’s duty to disclose evidence, post conviction.  He certified those issues as fit for consideration by the Supreme Court justices.

Nunn’s lawyers must still convince the Supreme Court to grant permission to appeal, but they are likely to find that easier following Sir John’s ruling.

Ms Walker lived in Fornham St Martin and had a two-year relationship with Nunn, said Sir John, but on February 2, 2005, they had broken it off. The prosecution said Nunn killed Ms Walker after a row, burning her body and leaving it near the River Lark.
